1. Acceptance of Terms

By creating an account or using Habib, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms that apply to specific services. If you do not agree, please do not use our platform.

You must be at least 18 years old to use Habib. By using our services, you represent that you meet this age requirement.

2. Description of Services

Habib provides the following services:

• Charitable Giving: Browse, donate to, and track contributions to verified charities
• Zakat Calculator: Calculate your Zakat obligation based on your assets
• Halal Stock Screener: View Shariah compliance information for publicly traded stocks
• Investment Tracking: Monitor your halal investment portfolio (trading coming soon)
• For Organizations: Tools for charities to receive and manage donations

3. Payments & Fees

For Donors

• All donation features are free to use
• 100% of your donation goes to the charity (fees are covered by the platform or charity)
• Payments are processed securely via M-Pesa, credit/debit cards, or bank transfer

For Charities

• Platform fee: 2.5% of each donation received
• Payouts: Weekly to your designated M-Pesa or bank account
• No setup fees or monthly subscription charges

For Investors

• Halal screener and portfolio tracking: Free
• Stock trading (coming soon): Commission per trade to be announced

4. Shariah Compliance Disclaimer

Our halal stock screening uses publicly available financial data and automated analysis. Compliance status may change based on updated company information. Habib is not responsible for investment decisions made based on our screening data.

5. Prohibited Activities

You agree not to:

• Use Habib for money laundering, fraud, or any illegal activities
• Create fake charity accounts or misrepresent your organization
• Attempt to circumvent security measures or access other users' accounts
• Use automated bots or scripts without permission
• Submit false information during registration or KYC verification
• Solicit donations for personal use under the guise of charity

6. Limitation of Liability

To the maximum extent permitted by law:

• Habib is provided "as is" without warranties of any kind
• We are not liable for actions of third-party charities or their use of funds
• We are not responsible for investment losses based on our screening data
• Our liability is limited to the amount of fees you've paid us in the past 12 months
• We are not liable for indirect, incidental, or consequential damages

7. Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Fail to complete required KYC verification
• Remain inactive for more than 24 months

You may close your account at any time by contacting support. Pending transactions will be completed before closure.

8. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya. For international users, we will make reasonable efforts to resolve disputes through arbitration before litigation.

9. Changes to Terms

We may update these terms from time to time. Significant changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use of Habib after changes constitutes acceptance.
